thanks. i feel really relieved i was thinking maybe i deserved it then. No he tried to bully my details from me however I refused and said i would pay in.
Iv now got their details and will be paying money into that.
I wrote a letter back just saying no court in the land would think i was guilty of fraud as i have actually made payments. i also advised if he thought it professinal to make my payments terms even harder on me? im so unsure how to go about all this debt, i have been to payplan but they just sent me letter top send as i have no spare income

    Hi 2011Fairy,

It sounds like you are having a terrible time of things at the moment and although we couldn't help you set up a plan we do have the Special Advice Team who can help you especially with this and also with setting up your own plans. Their number will be in the Self Help Pack that you have.

It is against Data Protection for them to inform you employer of your financial situation and they cannot demand money straight from your wages without an Attachment of Earnings. They can only apply for that after they have issued you with a Default Notice and then a CCJ. They also cannot send the bailiffs round unless they again have issued you with a CCJ.

    Thanks
    Lizzy

Please, let's get this terminology correct!!!

Only a Court can issue a CCJ. A creditor cannot issue a CCJ, they can only apply for a CCJ by suing.

The reason I am making a fuss about this is because so often people come on here and say "I got a CCJ from company X today". And you don't know whether they have actually only received notice of a case or whether the case has been heard and they have lost. So you have to clarify in order to find out whether they need help with a defence or it is too late for that.
