CCA Requests

HI all, sorry if this has been posted already but i keep seeing CCA requst threads floating around & i think i know what one is but how do i go about getting my creditors to check to see if they have one? Is this only used if you are about to get a CCJ or can it be done at anytime?

How do you know if its enforcable? x

    Can be done any time.

    Often a useful thing if you need to check the agreement/charges/terms that applied, need some leverage to do full F&F, perhaps discourage the creditor from court action or simply just 'play nicer'. Of course, if the CCA is after 2007 or correct, then it's not likely to help the latter.

    Any particular reason to do this now? Hassle with the DMP/creditors?

    LLoyyds are causing me no end of problems & i have recently reported them to the FOS. Its regarding a overdraft which i have just realised i probably dont have a CCA as its part of a current account? The account was opened 12 years ago x

    Yep. Overdrafts are exempt from having a CCA that you can request.

  • Poop! i have a credit card with them but that have been absolutely fine with halfing the interest but the overdraft they just keep piling on interest & charges :(x
