Link Finance help please!!!

I had a car load with Landrover finance which I paid off all but £1600. Went to court given CCJ and attachment to earnings of £40 which my employers dealt with. After several years of it been taken at source these ceased.

Approximatley 2 years later contact by Link finance (this was back in July) who told me that the debt had gone from Landrover Finance then too Ford finance???? and now through to LINK who owned the debt of some £600.

I have spoken with my payrol dept and been told that they have complied with all the attachement to earning orders that have been given to them.

Unfortunatley LINK has my phone number and I am being plauged by calls from them the last one this afternoon (Saturday) at 15.45.

I have a few questions and I hope you can help.

Can the debt be sold on given it is part of a court order and attachment to earnings?

Can LINK finance enforce the debt against me or do they need to continue with the original order and go back to my employers?

Can another CCJ or default be placed on my file?

If the previous finace companies (Ford and Landrover) failed to use the Attachment to Earnings order correctly am I still liable?

What advice can someone give on my next move with regard to LINK finance?

Thanks in advance as I am pulling my hair out with these clowns.

Regards

Andy

They can't ccj you again for the same debt.

I'd send link a letter specifically asking them to send you any ducumentation to PROVE they own the debt and have any right to chase. I'd also be asking for any statements that prove there is an amount outstanding as well.

Link are morons at the best of times.....;)

    Andy,

Totally agree with the chippys advice. Also send the letter below as well as the prove it letter and if they do call you again, don't go through the security check, tell them you only wish to be contacted in writing and hang up the phone. Link are parasites and it's best to treat them with the contempt they deserve until they can actually prove you owe the cash.

    Dear Sirs,

    Account No: XXXXXXXX

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

    Yours faithfully
If you've nothing decent to say, perhaps you shouldn't say anything.
