Thank you nottoolate, are you able to link to more information on this?
Or perhaps even a 'prove it' letter template more specific to my situation (where I have already sent a prove it letter and now to send another, this time requesting a specific document and stating what has been sent is not adequate).

    Thank you.

Edit: I have come across this template:

Which appears relevant, and also seems to be accurate, having checked the referred section of the Consumer Credit Act myself. Can I ask: Are the demanded documents relevant to my case and would the referred to sections of the CCA apply to me?

The CCA is about credit agreements - there is no credit agreement for a mobile phone. There should however be an airtime agreement.

You could use the national debtline template to request proof and specify that you require a signed copy of the airtime agreement as proof that the debt is yours.

    Thank you for the response.

Would I be right in thinking the following also applies to requiring a service agreement:
    1. You must supply me with a true signed copy of the alleged Agreement you refer to. This is my right under your obligation to supply a copy of the Original Agreement under the legislation contained within Section.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a fully itemised Statement of Account.

I will respond to Fredrickson today, thanks again for the help.

no. phone contracts have nothing at all to do with the consumer credit act.

so you can't quote or use that legislation
