disciplinery but had sick line

hi...thanks for reading am currently tryin to search the web for an answer but know there is alot of useful advice on here...

someone I know was off work - with a sick line handed in yet the work are goin to conduct a disciplinery , is this legal?! :eek:

  • I believe so. If you have excessive absence from work even though it is genuine and all signed off by the doctor it can be considered a capability issue and if it is likely these absences will continue then the company should start the process of capability.

    Although this is usually contained within the disciplinary process it should be handled sensitivley. Their employer should also consider if changes can be made to help them return to work or other ways in which the employee can be assisted. The situation will also change drastically if the illness can be considered a disability.
    There's no sense crying over every mistake.
    You just keep on trying till you run out of cake.

    I always like how people put the shocked face down when they believe something shouldn't be allowed :cool:

    Anyway, are we talking about a disciplinary for sickness or are we talking about a disciplinary for something else during the sick note time?
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

    As far as I am aware this is 'standard' procedure for the persons work place - I personally thought it would of been just a back to work informal interview as the pp stated... not an actual disciplinary!!

    Said person was absent in past (over two years ago) but this is due to bereavement of husband..

    I am just tryin to find out some facts before this is conducted to advise them should anything be said!
  • How long have they been off?

    Some companies do have standard levels so that the habitually ill are managed out of the company but those that have the very few sick days will at worse only get on one disciplinary level

    The company I work for is getting really strict on absence.... one absence of more than 7 days or 3 absences of any length in a rolling year 'triggers' the absence policy which means you can start being taken down a disciplinary route. Obviously this doesnt happen a lot with genuine illnesses but it is the official line. Every absence means an return to work interview.

    Well they were absent for a week with a sick note from docs so heck knows why it can be classed as a disciplinary matter, seems far beyond any reason to me.

    It would be helpful to know the actual wording of the disciplinary letter otherwise we are all p1ssing in the wind.
