Creditors wont acept my payment offer

Hiya

I have just started my Debt Managment Plan with CCCS and have just been told MBNA will not acept my payment offer and they have sent me a default, please can you advise me what to do now which Im really worried

    This is stadard fare from MBNA, try not to worry about it.

    You will find that some creditors will default you first before accepting a DMP. If you are with the CCCS let them keep plugging away at MBNA and you should get there with them in the end.

  • Agreed saltnvinegar! I find MBNA are really hit and miss to deal with- sometimes they accept my clients offer first time around sometimes they don't- very frustrating as there seems to be no rhyme or reason to their decisions! I usually fire off a letter quoting the Office of Fair Trading guidelines stating that they should not request more than the client can reasonably afford and then cross my fingers! Just give it time k_moor25 and they will get there with them! Btw- have CCCS explained what the process is if they don't accept the offer i.e. what's the 'worst' that can happen? It would probably put your mind at ease if they did! I usually suggest that a client put the money aside that they would be offering them anyway- but go with whatever CCCS tell you to do.

    A default affects your ability to get credit for 6 years from the date it is put on your credit file. I wouldn't worry though, as you won't be looking for any until the dmp is finished. Some creditors do refuse offers, but speak to the cccs and see what they recommend. Creditors and debt collectors basically threaten people who owe them money with just about everything up to the point of death, but usually do very little. Keep in regular contact with the cccs, make regular payments and things will settle down soon enough.

  • This is completely normal. They will do everything they can to avoid CCCS debt plans but I promise they eventually get bored, accept your payment and leave you alone.

    You must remember this. The worst they can do is take your to court. Now, when you go to court they can only force you to pay what you can afford - exactly what the CCCS does. They won't bother with court.

  • MBNA are very crafty with these, they will pester you but eventually give up and sell off the debt to DCA , just keep making your payments to CCCS and all will be fine. I was on a DMP for 3 years and went Bankrupt last year best decision i ever made.

    Hi k_moor,

    CCCS will send the agreed payment to MBNA anyway which MBNA can't turn away. The same thing has just happened me to, MBNA have refused my payment offer, although I haven't yet had a letter from MBNA themselves. CCCS have said in their letter to me that it's likely they will pass the debt to a debt collection agency. The advice from CCCS is for me to do nothing, they will still send the payment to MBNA. There should be lots of information in your DMP pack from CCCS, or take a look at your online DMP section on their website. Also they are very helpful to talk to, so you may wish to give them a call and chat to them - they are very supportive.
