Urgent advice needed please.

Hi

My brother currently works Mon - Fri 8 till 3pm, His contract says that he is contracted to work mon - sun, although he never has had to work weekends only Mon - Fri.

His company had a meeting in January saying that they want some of the staff to cover weekends (to include my brother) starting in febuary 2011 (no specific date given).

On monday of this week he was asked (by his manager) if he could work this weekend and he told the manager that it was a bit short notice and he already had plans for this weekend.

Today he was told by another member of general staff that his name has been taken off the rota not to work tomorrow (Friday) and is down on the rota to work saturday instead (this member of staff is another family member of mine and should not really have told my brother about the rota).

My brother has no access to the rota to see for himself what the management have changed.

None of the management have told my brother about this change to the rota.

If he goes to work tommorrow he's likely to be sent home as he's not on the rota and (as he already told management) he can't work saturday due to family commitments.

Surely his employer can't do this... can they?
Where does he stand?
Any ideas on what he should do?
Should he go into work tomorrow (as he isn't supposed to know about the rota change)?

Any help please would be greatfully recieved.

    He should ask to see the rota and either work accordingly or dispute unreasonable shifts and changes.

  • Why would he ask to see the rota as he has no reason to look at it, he's not supposed to know about the changes.

    he was told (in confidence) about the changes by another member of staff who shouldn't have REALLY been looking at them, obviously he doesn't want to get them into trouble either.

    Like I say, his contract says that his working days are Monday to Sunday so could he actually dispute unreasonable shift changes?

    How long has he worked there? How long has he worked his current hours? What exactly does his contract say?
  • I don't see how his employer can expect him to know when he is supposed to work if he doesn't see a rota with his shifts on. It does seem a bit strange that management expect their workers to know when to come in to work without seeing a rota.

  • because she was given the key to the office (for other reasons) and she had a sneaky look at the rota / diary as her days are supposed to be changing

    And therein lies your answer. He works when he is told or he gets sacked. No right to claim unfair dismissal!
