    cant remember the £8000 loan
That's alot of money to slip your mind.
Why don't you call Halifax and ask them if you are unsure?

If no payments or written acknowledgement has occurred in a full six year period, it's statute barred.

I'd just send the statute barred letter, by recorded delivery and do NOT sign the letter.

They have to prove that it's not statute barred before they're able to get any further - it's not for you to prove that it is.
  • i cant remember the £8000 loan because i cant remember taking out the loan in the first place!!!
i know i had a overdraft which has now been paid off....i will wait for the reply to the letter i sent them recorded delivery

    Well

It would not be the first time a threatening letter was sent to someone who did not even owe the money.

    Wait until they write.

And then start your own thread for help.

i have just received a similar letter from CQ, though still waiting for a CCA / statements etc, via their bully boys (aka mackenzie Hall), requested after they wrote last year..

nothing was heard from them, despite sending a follow up request, until now..

do they have a leg to stand on??

original debt was bought out from HBOS- just after I stated a reclaim of charges, which made up most of the balance..

I 've had NO breakdown of the extra charges or interest that CQ claim is now due, on top of this!
Long time away from MSE, been dealing real life stuff..
