Does the OH live with you? Is he liable for the CT bill as well as you?
(Add, if the van is required for him to do his job, the bailiff cannot levy on it. Tools of the trade are excluded). If you've have not made a mistake, you've made nothing0 -

my OH does live with me - but the c/tax is from an old address when he was not living with me and its only in my name (unfortunatly i didnt think at the time id add my now ex's name onto it!dam.)
from what i gather (from all the reading ive been doing!) he cant levy anything that is my other halfs anyway (which to be honest is just about everything lol!)
its rediculous because equita are not even collecting the council tax debt now (the council took it back luckily) and so the fees are litterly for not even a months ''work'' they only just sent me 1 letter and then came round! since the balieff warrent was suspended they have even sent me more telling me to pay in full (the original debt and fees) !0 -
I would definitely complain to the council as the bailiffs are working on behalf of the council and should abide by the rules and regulations. Hopefully the council will have a stiff word in their ear and they could in theory remove the contract from them and go with a different firm I believe if enough people complained. You just might be helping other people avoid these ridiculous fees.

ive moved districts - do i complain to my 'old council' where the debt is from or do i complain to the local council - sorry if thats a stupid question!0

Complain to your old Council.
And, they cannot touch anything belonging to your new OH
They could chase your old OH, as CT is a joint and several liability. Was he on the electoral roll?If you've have not made a mistake, you've made nothing0 -
*UPDATE*
hi guys,
ok after putting the fee breakdown letter in writing and sending by recorded delivery 2 weeks on i finally get a reply with a ''breakdown'' of my charges....
3 visits dated (oct/nov/jan) it states that no contact was made - but a letter was left.
2 liability orders - debt 147.58/fee 42.50
debt 430.18/fee 42.50
outstanding - 472.68
(if you've read my posts above - this will make sense...)
it says - 'any amounts verbally quoted by our balieff will only become payable after the appropriate action has been taken, I am sorry if our balieff did not make this clear.'
firstly this does not even add up with the original 'debt'!! (which balieff order has been suspended now and im paying the council directly - but that was £1000.18)
seccondly - i stated in my last letter that the warrent has been suspended but why have they added the debt to my 'fee breakdown'??
thirdly - that would make the fee total £85 - not 272 as the balieff told me!!
fourthly - can they charge me £85 fees? i was adviesd before they could only charge £42.50 - for both visits (both debt orders)
any help with a reply letter or general advice greatly recieved thank you0 -
reading that again,
it doesnt even add up!
shes written
debt 147.58/fee 42.50 total 190.08
debt 430.18/fee 42.50 total 472.68
outstanding 472.68
think she means outstanding 662.76!0 -
there is well known(to all bailiff firms) detailed assessment judgement regarding the collection of more than 1 liability order at the same time
Detailed Assessment Judgment of Throssell v Leeds City Council where the District Judge ruled as follows:
“Turning to the taxation it seems to me that notwithstanding the fact that there were three liability orders but one visit was made by one bailiff and the maximum that the Council’s reasonable charges can be is the result of applying the formula contained in Schedule 5 paragraph 2 (1) (b) of the Regulations”
they cannot charge so many fees if only one visit is made
I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
If you are in any doubt please seek legal/expert advice help0 -
Hi
I'm having trouble too. A few years ago I got into trouble with council tax due to money problems. I hae sorted this out with the bailiff and had a few account linked together which cost me £60 per account and I pay £50 per month which I stick to like glue. At the beginning of this year I had another visit saying I owed more moneyand when I checked this up it turns out that the council added some due to something to do with benefits (I do not have benefits but my daughter was at college or uni so got 25% discount but I was entitled to this) I asked for an explanation but have not reevied one and to be honest I forgot about it. THEN all of a sudden another overdue account was found even though I now pay my council tax. The thing is to link it to my other ones will cost £60 AGAIN and I just cant afford it as whilst I am not on benefits I am the sole earner and once my bills are paid I have less than £300 to pay for food and petrol to work each month. Its really getting on top of me. I have now received an enforcement order on the additional acount. Now I havent linked it to my other account (which is levvied agaisnt my car) so does this mean that it is not levvied against? As they are asking for £150 and I just do not know what to do.
Thank you0 -
Hi She19, you will get more replies if you start your own post, rather than post on one which is 18 months old. If you don't know how to do this, perhaps the mods will move it for you.0
