Default Query

I've read a few posts which state that a Default has to be issued within 6 months of the first missed payment - is this true? I started having problems making payments in August 2007 but my default wasn't issued until June 2008. Wondered if I could get them to change the date and then at least I 'only' have to wait until August 2012 for my credit search to be clean instead of June 2013. Obviously I know I still have to pay it off! I've had this default posted on my credit search twice and am currently attempting to get Cahoot to remove one of them but if I can't it would be some consolation if I could get the date adjusted!

It's not always as "cut and dried" as that. Especially if you are in an agreed arrangement to pay reduced amounts with the creditor.

However, there is detailed guidance here:

  • Thanks Fermi. I think it might mean that Cahoot should have issued a default on my credit card once a total of 6 full payments had been missed - looking at my letters from them this happened in Feb 2007 and by May 2007 they started to receive payments via my DMP. Otherwise I would probably better off not paying them anything until they had! If I'm right it should have been dated Feb 2007 for £4320 and not June 2008 for £3438. Is this something they can do? I've already complained to them and the lady who was so horrible to me last time I rang me three times today so just trying to work up the nerve to speak to her again...
