Recovering Direct Debit's

Can anyone help with some advice?

Here's the back ground.

Circa 2 years ago i ended a HP agreement by handing back the car as over half my payments were made and I found that it was in negative equity when i went to trade it in.

Anyway, foolishly i checked at the time that the company in question had stopped taking the direct debit's and yes, they had. HOWEVER :cry: I never cancelled the direct debit.

I've recently found out (today) that they have continued at some point to take the direct debit as i never cancelled it. :mad:

So i'm now in the process of finding out how much money they have taken, (it's somewhere between £750 - and £3200) depending upon how long they have been taking it for.

It also appears the debt or company has been sold on at some point as well.

Can i recover this money? How do i go about it?? Im going to make contact with the bank in the first instance to find out how long and therefore how much, then I will get hold of the original finance company and find out what's going on.

Out of interest is there any legal case precedence or FSA/ F Ombudsmen rulings or legislation to support me?

    Do you have evidence of when the agreement ended? I'd have thought an indemnity claim in the first instance - although for this length of time I'm not sure if it would work, the selling on of the debt is another potential fly in the ointment.

    Until how recently were payments being made?
  • So a company has taken money from your account over the last 2 years?

    You think it may total between £750 to £3,200?

    And you never noticed?

    This has got to be spam
  • Two many holes in the story isn't there?

    eg if lender had sent debt to debt collection they wouldn't still be collecting repayments would they?
