    By the sounds of things they've bigger things to be worried about - when companies are in danger of going bust all bets are off, and the fact that they haven't paid you means they have consistently broken their side of the contract. You're lucky you've got something better to go to so I'd go by the notice you've already handed in, explain that you're leaving on such a date and wish them well for the future.

    The only action they could realistically take is to withold/give a poor reference (which I'm guessing you don't need) or mess around over your last pay packet, possibly witholding it in lieu of notice. If this happens, refer to your existing and valid notice letter and pressurise tehm to pay you.

    I wouldn't put anything more in writing, but would refer them to your original letter (and the dodgy email if it came to it). This is personal advice on what I'd confidently do, rather than chapter and verse on the law. Take with a pinch of salt and good luck.

    Thank you, thankfully they have already paid me in full (for only the 2nd time in 6 months) so I owe them no money and they owe me maybe a day of holiday but I am not bothered by that.
    As I had revoked my notice I am just going to send an email informing them that due to personal circumstances I will not be returning and wish them well for the future.
    I don't need their references only my P45 now.
