Newbie help - Kays

Hello all, just joined to see if i can get help with a particular debt.

I have an outstandng balance of £1200 on a kays account which is now 4 months in arrears. I have questioned the amount as I am sure I have not spent anywhere near that amount. I have asked for statements but I am still waiting for them to get back to me.

I have asked for a copy of the credit agreement too... but no reply either, i have read elsewhere here that I need to send £1 or something?

They ring me everyday asking me to make a payment of my arrears of £330 which I cant do as money is tight as on a small wage...

And suggestions as to what I do next??

  • Do you have any or the paperwork they send you along with an order? Also you should have received statements once a month? Might be worth digging as many of these out as you can find, and tracking what you have bought - then photocopy anything relevant and write them a letter asking for a breakdown of the amount they are requesting, as you only have record of the enclosed photocopied orders.

    I think writing may be a better option than ringing, as it's cheaper(!), and also you can send the letter recorded delivery so they can't say they didn't receive it. You also than have a copy yourself if they deny all knowledge.....

  • Are you able to make any payment to them? As you don't seem to be disputing all of the amount, paying what you can afford would at least show you are making the effort, and whilst they are sorting out a "potential" dispute your arrears will not be rising quite as much.
  • I was paying £5 a month as thats all i can afford at the moment, but they are not accepting this as a token repayment, they say if i dont pay at least £100 a month then i will keep getting charged and they will default my account. They have threatened a default for the past few months as they wont accept any offer i give them less than £100, but they have not yet and it goes on day after day... a call from a different person... sometimes twice an evening.
