'Return item' case on ebay

Hi,

I want to return an item I bought that does not fit, as the seller's return policy stated returns would be accepted if the item didn't fit. I messaged the seller asking to return it but got no reply so opened a 'return item' case in ebay's resolution centre. The seller hasn't responded to that either yet, and I just wondered what happens if they don't respond? Will the case automatically close and after how long? And will I then be stuck with the item? The policy states the item must be returned within 7 days, but I opened the case the day after I received it.

    doesn't sound too much.

    Also what kind of claim did you open?
    'item doesn't fit' does not fall under not as described or not received categories

    Sounds like you may end up with nothing as ebay will not (as far as I know) allow you to return because it doesn't fit.

    What a result, the seller was not given enough time to respond, and will have a claim effecting their performance (which can cause all sorts of problems) and you will not be able to return the item.

    Actually on ebay there is now a returns section where buyers can ask for a return for things like 'doesn't fit' if the seller agrees to the return and refunds then the case is closed, if they refuse ebay then step in and if they decide in buyers favour the case is marked against the seller on their seller metrics.

    I had a return on the basis of 'changed mind' ebay gave me the option of accepting return (which I obviously did) or refusing and asking for ebay to decide on the case...and I assume they virtually always find for the buyer.

    I only found it out because someone did one on me. At the time I was a bit cross as I thought it was a proper 'claim' against me, it wasn't until I looke dinto it more that I realised it was just an ebay system for noting that a return has been requested and actioned.

    ebay should not just make up new rules without informing anyone, it's the only service you pay for where they just change rules as they go along...

    Previous messages I had sent the seller had been ignored so I could have been completely ignored this time also and I want to get it sorted.

    I'm fully aware that a case can not be opened unless the item is SNAD or not received, but the seller's returns policy states returns are accepted within 7 days "if the item does not fit". I would have been more reluctant to buy the item of clothing otherwise that I had not even seen never mind tried on without this policy. If the seller doesn't want to accept returns for this reason then fine, but they should not have that policy on their listings.

    As soolin has said, this won't affect their performance so perhaps you shouldn't be so judgmental against buyers (I am also a seller) and side with the seller straight off when you don't even know that it does in fact affect performance. If a seller wants the buyer to communicate with them when there is a problem, rather than with ebay, then perhaps they shouldn't ignore buyers' messages.

    This has been around for a number of months.

    In some cases under the Distance Selling Regulations (BINs from business sellers) buyers have a legal right to a change-of-mind return, so if eBay now facilitate this through a formal procedure, then great.

    It's the not the DSR bit that annoys me, is how this effects performance. Also this is a sneaky way of imposing DSR on non-business sellers.
    I don't think it's fair to impose it on private sellers who sell a few bits and bobs on auction, as it's clearly not meant to cover this type of sales.

    As a business seller it doesn't effect me in the slightest because I have a no-quibble return policy, and I also refund return postage if the items is faulty, or not as advertised. Probably that's why I've never heard of it before.

    Why should a private seller have to accept returns if someone changes their mind?

    I don't side with sellers, definitely not. I side with whoever I think is right.
    As I didn't know about this return process I assumed that you had opened a SNAD or similar, which would have been a scam. Therefore the strong response.

    I still think that one day is not enough time to respond, it's unreasonable to expect that from every seller.
    However at least that's not as bad as someone claiming SNAD after changing their mind about a purchase.

    I really shudder when I read about situations like this and realise what a minefield selling on eBay is. Even if you, as a seller do everything right, there is an ever present danger of someone thowing a spanner in the works and leaving a neg if they don't get their way - just because they can, without any fear of a similar response.

    I know from experience, not everyone on ebay is honest, but as an ebay 'hobbyist', I can afford the occasional neg. Congratulations to you small business sellers for hanging on in, in such uncertain times. Personally, I really wouldn't have the confidence to make that jump from paid employment.

    Maybe this thread isn't the ideal place to write this comment, but for the small businesses who are making a success out of ebay, 'respect!' ;)
