Getting out of a joint mortgage

My partner has recently got a divorce however he is still locked in a joint mortgage with Halifax. They have refused to take him off the mortgage even though his ex-wife who wants to maintain the house and is keeping up with the re-payments for over a year on her own. Halifax give as their reason for not removing my partner from the mortgage as it is less of a risk to Halifax and the mortgage was taken out based on both our incomes.

However this prevents him obtaining another mortgage. Can anyone advise?

  • Does his ex-wife have sufficient income to secure a mortgage for the full outstanding amount in her own right? If not, and others may be able to offer something else, I suspect his only recourse will be for him and his wife to sell the house and repay the mortgage and split any remaining equity.

    Has your partner got any children with his EX wife? If he has you cant force a sale without the courts agreeing to it!
