Secured loans

I had a secured loan on my ex wife's house, the deeds and 1st mortgage were in my name only as was the second mortgage by the finance company. As part of the divorce agreement i signed the deeds over to my ex, and also as part of it she was to undertake to release me from both mortgagee's.
But there is a debt collection agency after me now, I did pay the loan on and off until 2009, but have since stopped as my ex got difficult about seeing and speaking to the kids who are 23 & 17.
Please help as it is causing me a lot of stress which is making me very ill.

    Have you got the mortgage releases on paper anywhere? Also, it sounds like if you were paying a loan and stopped, that'll be why they're after you. Get this all on paper with dates as to who agreed what and when.

  • The only people who could have agreed to release you from the mortgages and secured loans would have been the lenders.
    If you used a solicitor he should have sorted this out for you.
    I hope you don't end up having to stump up the money now.

  • It is in my financial statement i had to do before the judge would agree to the absolute. I stopped paying when the finance company said there is a charge on the property. Thanks for answering

    Thanks woodbine, She stopped me seeing the kids when they were 9 & 14 and as now turned them against me, same old story for dad's....:(

    Sounds like you may benefit from seeing a lawyer then, perhaps the one you used who has records of signing the mortgages over to your former partner. Sorry to hear about the kids - but as long as you keep sending the birthday and christmas cards one day they may want to know, you know?

    As long as you or your solicitor have the proof of this you are in the clear.
