Company car fuel question

Hi all
Just wondering if someone could confirm what I've been told today..
This person has a company car but because he has to pay for his fuel (rather than get a fuel card) he can claim the difference of what he gets from his employer and 40p ie his company pays him 12ppm and he claims 28ppm from HMRC.
Does that sound right? He's spoken to two people at the tax office and both have said it's correct.

The link below shows what you are allowed tax free when it is a company car.
The 40/25 ppm is only if you are using your own car.

He can claim the actual cost of the fuel used for business miles, minus any amount his employer's already paid. He will need to provide records proving how much of the fuel was used for business miles.0
