joint Mortages

My boyfriend has a joint mortage with his brother they have been sharing a house for the last 6 years, now my boyfriend wants to move out get another mortage with me. Throughout the six years my boyfriend has been paying more towards the mortage and has had enough with his brother not paying up, now his brother refuses to pay because he has not enough money coming in, what has my boyfriend got to do about this? Has he any writes to make him pay or chuck him out ??? Any advice will be taken thanks for anyones help.:o
