Will I never get my tax refund?

I had to send the return by post due to filing for bankruptcy in the year I was doing the SA for. I know I was entitled to a refund as I earned well below the threshold but still paid full tax on my income for the first couple of months of the tax year. I posted the SA via recorded delivery and I've never heard anything about it. I called them last month and they said it hadn't been received. Tried calling them today and hung up after being on hold for over 30 mins. Is there no way I'll ever get my refund if it has been lost? I don't understand what they expect me to do. I sent it on time but if they didn't receive it or if they lost it, is it just tough and they get to keep my money?

    If your due a repayment in the year in which you were bankrupt, it will be first offered to the Official Receiver. It is highly unlikely you will receive a refund.

    scoobs is correct, the refund will first of all be offered to the OR. Only if they confirm you have discharged all of your debt will any residual funds be forwarded to you.

    You say you sent the form recorded delivery, have you chacked to see that it was infact delivered by RM.

    If they cannot confirm delivery I would advise that you print out a return from the internet and resubmit.

  • I can't submit it now, can I? I thought they'd just reject it since it's past the deadline.

    The tracking number just says it's in progress. I was told that they usually don't bother updating the tracking when someone is delivered to a very high volume address.

    With me being discharged from bankruptcy over 6 months ago, would the OR still be allowed to retain the money? Suppose it doesn't matter anyway as I'll probably never get it now.

    That is true .... and sounds the precise wording I've used on previous threads. Bear in mind HMRC still get a lot of paper Returns .... and they take ages to process and farm them out to different offices. So it may still be in a pile somewhere as they certainly didn't process all the paper ones by 31st Jan last year.

    They should capture the reference (UTR) via a barcode reader to indicate it's been received ..... but!

    Regret I'm unsure about the OR question.

    Submit it again, it will be accepted. Assuming you do not owe any tax the late filing penalty will be capped at £0.00

    Even if the original is waiting to be dealt with, there is no problem sending in another. Assuming all the information is the same it will simply be archived or destroyed.
