I will write to them of course, but can they remove the default after issuing it?

Yes, the issuing company can remove a default - it's down to them and not the CRAs. Whether or not they will is a different matter.

I would recommend to stick with writing a letter though as that way not only do you get to keep proof of what's been said, but you remove yourself from any frustrations of talking to someone on the phone which can lead to heated conversations that wouldn't go in your favour I'm sure.

As Jeff says - well done on clearing so much and so quickly too!
My posts are my own opinions based on my experiences and info gathered from sites such as this.
They are not a substitute for professional financial advice - but you knew that already didn't you? ;)

    Thanks Hax, much appreciated

Putting a letter together now - will let you know how I get on, although I am sure we have an idea
  • Hi HSBChell,

My husband had a default removed from his credit file. He had it issued by a mobile phone supplier after he failed to pay a final bill of £28 when he switched companies. The default issuer was partly responsible for him not paying (sending final bill by text after he had cancelled his direct debit) and, after 6 months of negotiating, agreed to take it off his file.

I don't believe it is the case that you have to have been issued notice of the default, or at least it didn't apply to the phone company.

The best tactic it would seem is to write to the department responsible for putting it on your file in the first place. I wouldn't be stroppy or demand anything in the first instance, just explain the situation and see how far it gets you. Like someone else said, non payment is non payment. Circumstances are irrelevant unless someone at the company thinks they are... in which case you need to get them on your side.

    Hi Penny,

Thanks for the response - as you say, no use in shouting as it won't get me anywhere

I believe that the lender (HFC) should have issued some form of notice prior to issuing the default.

Google "Notice before default" or "Default notice letter"

Anyway, I found a default on CallCredit from a lender from a year or so back, challenged them (the lender) to produce a copy of this letter and they could not so they contacted CallCredit and had the default removed.
