I have been away for a couple of weeks and in my absence have received a letter from Link. They have sent me a supposed copy of their "notice of assignment", allegedly sent to me and also a reminder about the Tomlin Order.
I have absolutely NO record of Link's original "notice of assignment",which is very odd considering I have every other piece of correspondence received from them.
This copy looks like it has been fabricated - does this sound like something Link could or would do?"happiness is...positive cashflow!":j0 -
Yep,
Fabricated noa's are not uncommon.
You just couldn't make it up could you!!Happiness, is a Kebab called Doner.....:heart2::heart2:0 -

snore! after getting the dreaded CapQuest stat demand off my back recently....Link are going ahead with court action. the paperwork has gone to northampton county court and the case is now being transferred to a local court.
yet another battle to deal with...aarghhhhh!"happiness is...positive cashflow!":j0 -
i've just looked through the paperwork and it looks as though Link want to pursue their claim through county court. Written on the general form of judgment or order is something that says if I want to have the judgement or order set aside I have 7 days (from when I received the papers) to do so. the judgment says:
1 the stay on claim to be lifted
2 claim to be transferred out to defendants local county court
3 there be no order as to costs
is this the same procedure as having a stat demand set aside or is this to have the above Order to be set aside?
the 'local' court that this has been transferred to is anything but local so it's unlikely I'll be able to file my paperwork in person.
Can anyone help with a bit of advice as I have never had to deal with a county claim before (just stat demands)
there is also an Allocation Questionaire to be filled in by me which looks terrifying
thanks in advance! x"happiness is...positive cashflow!":j0 -
Hi moneymeltdown
I saw your post this morning but was hoping someone else would answer...
Anyway, there's nothing to set aside at the moment. You do need to return your allocation questionnaire (no fee for you as you are the defendant), and that's all you need to do for now. It is pretty straightforward. Let me know if you are stuck on any particular question.
You will then get a date for the hearing.0 -

eeeek...this allocation questionnaire looks quite complicated to me! is anyone out there that could offer a bit of advice if poss?
I really don't know where to start - I'm used to setting aside Stat Demands and not filling in these county court forms!"happiness is...positive cashflow!":j0 -
What question are you having problems with?0
