Capquest - help needed

I received a letter from Capquest at Christmas regarding a debt owed to National Westminster for £1100.66!! The last I heard from natwest I owed them about £100 7 or 8 years ago.
I then received another letter dated 29/12 saying if I paid by DD it could save me money ie I pay £50 and they will credit the account with another £15. I was going to send the statute barred letter (this account is NOT on my credit file) just after Christmas but unfortunately I was rushed to hospital for emergency surgery which I am still recovering from therefore the letter has never been sent.
Today I received another letter dated 20/01 that states.
Despite our numerous attempts to assist you to find an amicable solution to settle this account the balance remains unpaid.
Our investigations into your current financial position based on information we currently hold are now complete and it is unfortunate that we find ourselves preparing a statutory demand under section 268(1) (a) of the insolvency act 1986 which will be completed on or around 2nd Feb 11 which will be served upon you. Then there is some legal bit about setting it aside and that they may present a bankruptcy petition (I own nothing of any value)
It says I can stop this by contacting them by telephone and pay a settlement of £660.40 but I must accept this offer by 2nd Feb. This settlement can be over a time period that can be negotiated around my current circumstances.
Someone please help, during my surgery I lost a baby and really am not strong enough right now to deal with this too.

    Be advised though that CRAPquest will probably "make up" a recent payment to try and con you into thinking that the debt is not barred. They seem to be doing that with a lot of people at the moment. But predictably, when pressed, they don't have any evidence whatsoever. Lying barstewards!

    take that letter with a pinch of salt, i had one at the beginning of december, didnt even get the SD set aside and they just handed it over to scotcall who claim they are coming to knowck on my door. Capquest have been reported to the OFT by me and im just waiting for the response off them.

    In association with this, I had a letter from a company called JBDR about a debt I owed and a reference number, I had to called to find out what it was about. Got told itwas about a American Express debt I owe, I told the gentleman that we had a letter from capquest quite some time ago stating they had written off the debt. He told me to find the letter and fax it to them! Trouble is it was so long ago but under 6 years and now I can't find the letter, kept it for ages but now it's gone. Where do I go from here?

    Hi,

    Capquest do seem to specialise in collecting debts that are statute barred (no payment or acknowledgement of the debt has been made in 6 years or 5 in Scotland), so they bank on people being frightened enough to start paying money towards it etc. They buy loads of debts at a time and while the letters will make threats, they won't follow them through for a statute barred debt. They may try to harass you on the phone or as they already have by letter though, but hang up and burn or return the letters.
    If you've nothing decent to say, perhaps you shouldn't say anything.

  • In response to your post, I received a letter from Capquest recently requesting and unpaid debt of £322.00 on an account with Bank of Scotland I closed over 9 years ago and have had no further contact from the bank since. I called them as I do not hold any information on this account and they asked me to write for details from the Bank.

    I sent the letter explaining my sitiuation and in the meantime I received another letter threatening court action, I spoke to another person at Capquest who said it would be unusual to contact a customer when the last account transaction was over 9years ago. Which arose my suspicions and hence my search led me here.

    Other than this I have an excellent credit rating and I am worried that this matter may adversely affect this. I would appreciate any advice on this matter. I intend to re-write using the template letter with my previous letter, but any advice would be gratefully received.:)

    If it was 9 years ago, I'd say that you're well in the clear.

    CQ can't register a 'new' default for a default that happened 9 years ago - any default that they register would have to reflect the exact date of default.

    And after 9 years, it would be extremely unlikely that they would know or be able to find out.
