loan

-over the last few years, l have been trying to be debt free
-l have cleared all my debts
-at present l am left with one loan with Lloyds tsb
-l have been struggling to pay it over the last few years
-early last year l wrote to them requesting for my mis sold ppi
--they never refunded me the money, instead l just saw a reduction in the balance of the account
-at the same time l wrote to them requesting for a copy of the original signed agreement
-lloyds tsb failed to provide a copy of the original agreement
- was suppose to have paid off the loan in 2010, however since l failed to do so, Lloyds tsb has informed the credit reference agencies that l have defaulted the account
-this has messed up my credit file badly
-l am still paying the loan account as agreed
-l have since taken the matter to the financial ombudsman services
-my query was that since l was paying the agreed monthly repayment was it fair for Lloyds tsb to inform the credit reference agencies that l had defaulted the account

Qst:
>any chance that l might be successful in reclaiming pii
>any chance that the loan can be written off, if yes how
>any suggestions on what step to take next

Please help, if l get this out of the way then l would consider myself to be debt free

    If the loan was taken out until 2010 and by then you hadn't paid off the full amount then you cannot have been making all the payments on time for the duration of the loan - so yes they can and should issue a default.

    Qsts
    1 - it sounds like you have already reclaimed the PPI -they are entitled to reduce the balance owing to them for a PPI reclaim, whcih is what they have done.

    2 -No, loans are not written off, even if no credit agreement can be produced.

    3- either continue to pay the loan off in full, so eventually your credit file will be updated to show a settled account and settled default
    or ask them again for the consumer credit agreement (did you use a template and send the £1 fee last time?) and if they fail to send it to you, you could write to them to say you are ceasing payments until this is sent to you. If you do this they can continue to report your non payment to the credit reference agencies.

    You wait for an answer from them. Chances are they send it out to you in a couple of weeks, or they send you a letter saying they are looking for it or something similar.
