Hello,
I bought a house with an ex-partner. We bought the house for 195k with a 15% loan from my dad for the deposit, we signed an "acknowledgment of debt" document saying "on sale or devolution of the title, the sum of XXX will be paid back" and "any shortfall deivded equally".
The problme is that we broke up and things turnd nasty. We also had a joint loan together which she cliams (quite rightfully) that i used most of (to buy a car) when we were together she paid this loan. I have agreed to pay off the balance in full. Seh refused to sell unless i backpaid all payments.
I went to see a solictior, to apply for an order for sale, this promted her to see a solictior who have suggested that the sale can go through, but the "net proceeds of sale" remain with the conveyancing solictior until arrangement agreed. My solictior is on holiday for a week and i am getting worried, my dad cant afford to get this money back. Does she have any entitlement to it?
