dont know where to turn, please please help

  • I have checked with every resource i can find to see if i can get any mortgage help, even the prison welfare, but no joy. the secured loan was for £5000, i have been paying it for 18months at £150 per month and its over 5yrs, i even asked them to freeze the interest and sent proof of where he is but they not willing to do anythng. when i asked the mortgage company (natwest) they suggested renting one of my bedrooms (cant see anyone wanting an 8ft room) to someone, or selling the house, after what my ex did, obviously i would be wary of letting anyone in my home, or they suggested selling, which is not an option. i think my only option is to file for bankruptsy and let the bank reposess. does anyone know what kind of credit checks the letting agents perform? and thankyou once again for your replies, its helping just to talk.

    Can you not sell now and then money that would be "due" to him for the sale be put into trust or something?
    Surely its better you sell now and he gets something rather then lose the house and you both get nothing!

    OK, so there is probably enough equity to cover the outstanding mortgage and what is left of the secured loan. So if you can sell up, you would be OK?

    Sorry but BR will not necessarily work for you. Firstly, BR covers unsecured debts, not secure debt. And given that there is no equity, the OR might well leave you in the house, as your portion would not be worth having. Your ex might be offered the Beneficial Interest.

    If after repossession the property sells badly enough, any shortfall would transfer to you both jointly and severally and then you might benefit from going BR. But you cannot guarantee that there will be a shortfall. So you could lose your home, wreck your credit record and have little or no shortfall.

    This is not right forum for you, as I suspect there are people Housing and the Families forums who could guide you through getting permission to sell, which must be your preferred option.

    There are ways of doing this as others have referred to court order sales. And at least you have not have an antagonistic ex living in the house trying to put wreck the sale.

    I know very little about these kind of things; but i have just googled this for you:
    If Your Partner Refuses Permission

    If you want to sell and your partner doesn’t (or vice versa), one person can begin an action of division and sale in court. However, the other party can petition the court to a division of the proceeds, or to buy the place at a market price or one decided by the court

    It certainly sounds like your best optin is to sell the property; even if you have to force the sale

    As above poster said people on the home and family forum may know a great deal more

  • If you have a joint tenancy you can sever this, I believe, which protects your share of the property.

    I wonder if Shelter, the housing charity, might be able to help you. They are probably more used to keeping people in houses, but they have people (and I believe lawyers) who know all about housing law and would be able to help you force a sale. Other charities might help you arrange the sale too, to help you and your kids make a complete break with this man.
