responding to written warning

Hi, just before christmas my OH got a 2nd written warning from work, its 4 pages long and is whilst some of it is correct there is alot that is complete rubbish.
So we feel the need to respond to it and OH will also be putting in a personal grievance.
Basically, this has stemed from him being off sick for 5days, he called in sick on time everyday to the HR woman, and on the 4th day she said about him needing to provide a sick note otherwise she wouldnt pay SSP, he corrected her that infact he didnt need one untill he's been off untill he'd been off for a week as he could self certify but thought he'd be back the next day.
I was with him at the time, our landline only works on speakerphone or you cant hear anyone so I heard the conversation.
Now she's put in a grievance that he is rude, unhelpful and disruptive to the rest of the office! I am bloody furious... that guys in OH's department (and the CS) department dont like her anyway she's a real nasty peice of work but is having an affair with the CEO so what can you do!
So now she's given the top dogs all this bull about OH being late 10 times when 8 of those were less than 10 minutes and due to the snow, the CEO lives in the next village behind us and didnt even make it in most of those days - however we are accepting of that as a reason to get a written warning as he shouldnt be late.
theres a section about sickness which hes had ALOT of over the year, were not sure whats wrong with him to be honest and are getting that investigated by a doctor - again we are accepting the days of sick as he has had alot. but within that section there is abit about him being seen consuming a mc donalds in the evening?
I had to laugh when i read it as what actually happened is the boss saw him getting some drinks out of the car for me at lunchtime, as i was inside sorting out the kids. - I feel whilst agreeing that it doenst look great tht conclusions where jumped and it is infact untrue that he was seen 'consuming' anything.
then there's a section about doctors appointments saying that again he has had alot and is deliberatly choosing to have them a disruptive times of the working day. he works 9-5.30 mon-fri he either books appointments as early as possible or as late as possible in the day i dont really see how he can do any different. His GP doesnt do early morning appointments.
Then there is also a bit that says that he lied about having a doctors appointment for himself when it was actually for me. Well that is complete rubbish, he had a mornings unpaid leave cleared by his manager to take me to the docs.
and to top it all off, they've written this letter by a solicitor and then made OH's manager sign it. in there meeting manager said the letter wasnt from him, but he had to sign it.
I know people might think manager was just saying it wasnt from him, but it genuinely wasnt there good friends in and out of work and in OH's apraisial a few months before he got a really really good apraisial from him.
I'm not even sure if its legal to force his manager to sign something he doesnt agree with? bascially manger is leavign as soon as he gets a new job but doesnt want to risk his reference as it a small company and his ref will come from CEO, 2 IT guys have just walked out in the last 4 months, all 3 apprentices refused to stay once there year was up. 2 customer service girls burst into tears and walked out within the space of a few weeks of eachother lol.
every single member of the warehouse team went on strike a couple of weeks ago which was hilarious the company management is ridiculas.
So we are now wondering what is the best way to reply to the warning and get it corrected? we accept the lateness and the sickness, but not the other things, we also think we should request his apprasial for our own records and we would prefer it if he had prior notice of meetings now so he had a chance to take a colleague in with him as its getting beyond a joke, its really effecting him at home and he dreads going into work.
The HR woman is now logging onto his computer 6 times a day to check what he is doing and ringing down to the department everytime to ask one of the guys whether he's had his breaks what he's doing etc... OH is feeling harrassed not to mention its disrupting the office and the rest of the guys and their all pretty p*ssed off about it all.
he's nearly been there a year and i keep telling him just to hang in there untill he's been there a year and then we have more grounding to deal with it.
I guess my question is how do we reply to all this, he's now taking logs of everytime she logs onto the computer and when she rings down. How do we deal with that letter not being written by the manager and all the rubbish in it?

If your OH is invited to disciplinary meetings he must be given sufficient notice. He should also be entitled to see any appraisal. He is also entitled to be accompanied. A union rep would be good.

It does not matter that it was not written by the manager, however it must be factually correct.

Unfortunately if he's been there less than a year he has very little rights. If they want to get rid of him they can just say he's unsuitable for the role and,providing they follow good practise in the disciplinary process, unfortunately there is nothing that your OH can do about it.0

Does he belong to a union? He should speak to his rep if he does. You need to respond to the letter addressing each point factually, don't talk about opinions and do not mention office gossip and other collagues leaving etc. If you believe something is incorrect then you can ask for evidence of this or to have it removed from the letter eg the half unpaid day.

So cutting through the irrelevant waffle, your OH has been late numerous times, has had extensive sick leave and is on a second warning? I would suggest you do the following:
- Start cutting back
- Save as much money as possible
- Start looking for another job.
Even though he has now passed the year mark, it really doesn't look too good for him.0 -
The problem is that he has raise suspicion that he is messing about by not showing full commitment to the organisation. I assume you stating 8 times of 10 he was late less than 10 minutes means that he was late more than that for two. Mentioning the CEO is irrelevant, the CEO might be working from home, probably doing late evenings etc..., so not comparable.
As for the mention of getting drinks mcdonalds out of the car, what does this mean exactly? He was carrying mcdonalds drinks? Does this mean he had gone to McD to buy the family lunch? If so, what was he doing driving there when he was supposedly ill. The fact he was seen then will endoubtably raise suspicion to what else he might be up to.
I personally would face this in an apologetic, humble way to justify his position rather than making them seem totally unreasonable.0 -

Whether what they have said is true or not or whether he responds or not they presumably can't escalate it to the third stage if he keeps his nose clean and is a model employee. If he wants to keep his job that's what he needs to do.Make £25 a day in April £0/£750 (March £584, February £602, January £883.66)
