help - bailiff clamped my husbands car today

    I agree, however bailiffs may claim that it's lawfully applied and then it's a long winded argument about wether its right or not to remove clamps. Personally I would leave it rather than take it off, and harass them to remove it as they're breaking the law, I would rather argue knowing I'm in the right.

    The reason for posting was just to say that it maybe an offence to remove. I'm not an expert on these matters!

    Still shocked that they behave like this though!

  • Don't have anything useful to add to this as the advice of previous posters seems quite good. I especially like the idea of adding the cost of transport to the bill; I think this is entirely justified!

  • When "aah's" husband paid of the debt did he in some way indicate he would underwrite any further sums due arising from the same matter? As others have already suggested, was the son obliged to pay council tax? If he was not, how has the scenario reached this advanced serious stage? Was the son aware the Council was trying to collect council tax from him? If yes, what did he do about it? The regulations quoted appear to relate to DVLA matters. A solicitor would readily advise if there are kindred like regs available to bailiffs. The Council is a Public Authority. The bailiffs appear to be acting as the council's agents. I would seek legal advice as a matter of urgency. If "aah" or husband's human rights have been breached then they may have a right to compensation.

    If the clamp has been removed then they have to prove who removed it as it could have been a passing stranger.......... like Angle Grinder Man
  • If it was my car i would remove it aswell.

    I would go out with my OH's grinder, get it off, chuck it somewhere never to be found and play dumb. what clamp? i never saw one lol.
