Help needed RE: Taking a name off a mortgage

Hi all,

I need some help and I have absolutely no idea about mortgages so apologies if none of this makes sense, I'll start from the beginning.

My boyfriends mom took him and his brother and sister on holiday 24 years ago. The dad was meant to go but something came up with work. When they got home he had emptied the house of everything with any value, emptied the bank accounts and re-mortgaged the house and went to live with another woman.

She divorced him shortly after.

All this time he hasn't been in touch, hasn't paid any maintenance and has no idea whats going on. Its as if they didn't exist anymore.

The mortgage that his mom has been paying all by herself all this time is due to be paid in full in 6months time. But we have just found out his name is still on the mortgage and the deed to the house?

Any idea's how we can get his name off so that he has no claim to it? He hasn't paid a penny towards the house or the children in 24 years so we want to make sure he can't crop up and try to take his half.

Any advice anyone could offer would be greatly appreciated.

Thanks, Lois

What were the terms of the divorce settlement?

I haven't a clue, I'll find out though and post. Sorry I really haven't a clue about anything like this and nor has she.

Is there anything else I should find out too that someone would need to know to be able to help?
  • Speak to the solicitor who dealt with the divorce.

She can't unfortunately, it was just over 20 years ago that the divorce was initiated and completed and the same practice isn't in business anymore - thank you though.

Check with the law society, most solicitors that close will have some form of continuity, and there may be some paperwork still available elsewhere.

  • Sorry this is probably going to be another silly question, whats the law society and how do I find it or find my local one?
