What processes take place when someone makes an offer on your home up to the point of it being sold?

I'm not selling a home, but i need to understand this as my mother is thinking of doing so....however she also has a solicitor who is willing to fight a case against a loan company that has a charging order on her home. If my mum sells the solicitor cannot continue. My mum has had an offer on her home. She is wondering what to do. If she sells she is set to resolve the problem that she has of finding it difficult to make the loan repayments (since her husband passed away suddenly).....if she doesn't sell she has been told she has a good case for a legal negotiation with the loan company with a potential settlement that could mean she could stay in her home. Regards paying the loan company, they are currently agreeing to a reduced payment that she can afford...and this is what the solicitor is going to claim for also. My mum is paying regularly and on time.

just a bit of a dilemma here and she is going to have to make a decision soon.

  • Hi, pressure is being put on her to sell from the loan company - they will ultimately reposess unless the terms can be changed....

    No life cover, there was, but it's a long story and it's all been checked out. :-)

    Let the company take her to court!
    No judge would throw her out in the circumstances you describe as long as she makes a reasonable attempt to repay.
    This could be as little as £1 per month - let them do their worst.
  • Thanks for your thoughts...the thing is she doesn't want the worry anymore, she doesn't like uncertainty, for the last year and a few months she's lived with thinking she will get summoned to court. So far it hasn't happened and she is paying regularly, but i thought that was just the company going through their 'pre-action protocol.'

    Even if a judge wouldn't throw her out immediately - i doubt there would ever be a situation where s/he would say she's entitled to stay at the home indefinitely. Without that kind of certainty i think she will want out....

    Would they agree a charge on the property, so when she does move out for whatever reason, they collect then (with interest, of course)
