credit agreements

hiya, i wonder if someone can give me a bit of advice when i was allot younger i took out loads of credit in the form of catlogues and then didnt pay them, i am now older and a little wiser and have a little girl me and my partner are trying to get our finances straight and before i carry on paying my debts i want a copy of my credit agreements and statments i wrote off to a compnay that had one of my debts called reliable collections today they dent me a letter back saying they inclosed a copy of my agreement and it also states ' when responding to section 78 request, a lender does not have to provide a photocopy or other literal copy of the executed agreement nor provide a copy bearing or some other proof of the customers actual agreement' what does this mean they have enclosed a copy of a credit agreemnt but i havnt even signed it how do i stand where do i go from here coz reliable collections are soo rude and threaten to send a collections advisor to my home

    They don't have to provide the actual copy of your agreement.

    You still owe the money and can't use lack of original agreement as a reason not to pay.

    If you are really struggling, pay a visit to Citizens Advice for help.

    Agreed, it means if you are thinking of looking for that signature which is slightly outside the box as a way to avoid repaying your debt, think again.

    You have been given an example of the document you signed at the time, just because you can't see your signature doesn't mean you can haplessly deny any knowledge of the debt.
  • thanks for the response i am not trying to get out of paying i understand that i took out the debt but if they take me to court i read it dosnt stand as its not signed there is no signiture at all on the credit agreement... they are not even willing to compramise a repayment plan

    They don't have to send you the signed credit agreement they are allowed to send you a copy of the terms as the appeared on the original agreement.

    When you say that won't compromise on a repayment plan what have you done so far? Have you worked out how much you can afford to repay them (and any other catalogues/creditor) each month? Have you written to them with this offer? have you started making the payments you offered?

    If you have several debts you are trying to repay then it might be useful to get some advice from one of the debt charities?
    How old are the catalogues debts by the way? when did you stop paying them?

    They won't, well not willingly anyway, they simply want their money back.

    you can deal with it yourself but as Tixy mentioned, going to one of the debt charities will help (e.g. CCCS) as they will take a lot of the burden off your back.

    They can't have what you don't have so it isn't the end of the World, you just need to understand exactly what you can sensibly afford whilst still being able to put food on the table.
