Barclays loan nightmare
Hi there,
If anyone could help it would be greatly appreciated.
I took out a loan for £3000 with Barclays in 2005 at a staggering 20% rate (I know). It has take a long long time for me to pay it back and was often late with payments and fell unemployed to which I used the PPI I was sold with it. I had paid as far as I knew all my payments and got a letter stating that the loan had all been paid off. However then there was another amount that they said I had to pay off. I disputed this.
I made many complaints as they said the loan had been paid off, after a long dispute a nice man from Barclays told me over the phone that all was settled and they wouldn't be looking for the disputed £300 odd. That was approx 9 months ago. Im now after coming back from new year and there is a threatening letter from Credit Solutions saying that they will send bailiffs etc for the money. I called Barclays and they said they no longer had records etc for me and I would have to deal with CS. Im a a bad situation as I took what the man said on the phone as bible. silly me. If anyone could help I would be eternally grateful.
*** Just found the letter from 2009**********************************
"Dear MR OC
we would like to confirm that your final payment becomes due on 30th Jan 09 but must inform you that the amount required will be £237.74
this is different to your usual repayment amount as a consequence of the way total interest owed is charged over the lifetime of the loan.
please contact your bank and arrange for your payment to be amended to the revised amount"

I forgot to add that on 4 seperate occasions I would be called endlessly to tell me that I had not made payments when I had not to mention just generally being massively harassed. Also I am pretty sure my credit rating is in a very ugly state because of CS's involvement; Could I take these/Barclays to court????
They have been making my blood boil for too many years now.

That letter doesn't say the loan has been paid off.
Was that payment of £237.47 paid prior to 30 Jan 09??
This would be pivotal if you can prove that payment went in on time, if not, then a missed £237.47 plus late fees etc would equate to around £300
If that final payment is what you are/were disputing, it could get difficult as the final payment was missed and remains outstanding.
Hindsight is wonderful but it would have been better to make that payment on time and dispute it afterwards.
You would have only been fighting the £237.47 as opposed to all the fees piling on top (along with the move to DCA)

Many thanks for the replys. I did pay off this final payment. I cant remember exactly when but I believe it was on time. This whole dispute arose after I had paid this and they said I owed more. sorry if I didnt make this clearer.
So I should be in the clear right?

Does the letter from credit solutions say they will send bailiffs? Or does it say something more vague such as field agents/debt recovery agents etc.
If it definitely says bailiffs then there would need to already be a county court judgement for this debt. Its important to know whether there is or not as it makes a considerable difference.
What other letters did you have after the one above that said you owed more money? Without knowing what later letters said and the reason they said you owed more then its not possible to advise whether you are 'in the clear'. You also need to check back for certain to see when that payment was made. Can you see the payment on your bank statements to prove that you paid it in time.
