A bit of advice on charging order and F&F

  • Thanks Fatbelly - I will look into the Land registry today and pay the £4 and hopefully it will all be on there. Just a thought, well one my hubby had at 3.50am this morning and had to wake me to ask me lol. When making the full and finall settlement offers to #1 & #5 can they find out from the land registry too that #'s 2,3 & 4 are not full charging orders and ask for the full amount?

    we have no problems in paying them all off if we have to but if we have some equity left it will enable us to either pay the whole 6 months up front on our rent when we move or offer more F&F to other creditors that are unsecurded and small, once these are gone we can work on the larger ones.

    Off to look at the land registry site now and hopefully buy the deeds

    To answer this - yes they can find out if you have a full charging order or restriction - but once you sell your house the full charging orders will be paid with the sale funds & the restrictions will fall off on completition (read the link I posted again to explain this in detail). Since judgement has been made on those debts (i.e. a co/restriction has been granted by a judge) once you sell your home the creditors cannot chase you again for these debts through a court, but they MAY be able to chase you through phone calls, letters, etc, (I'm not 100% sure but I really wouldn't worry too much about that - I've never heard of that happening & I've read loads on other forums as well.)

    I understand how much of a minefield this must be to get your head around but try to read up on co & restrictions as much as possible...hope this helps & good luck! xx
