Underpaid tax??

I recently received a P800 tax calculation stating I'd not paid tax for car benefit and car fuel benefit for the 2009 - 2010 tax year therfore oweing £1581. I was very suprised to be informed of this as I thought my employer would have used the correct tax code or the HMRC would have adjusted my tax accordingly as they had recieved the P11D expenses and Benefits form. Could my employer or the HMRC be liable for the cost of the underpaid tax if they have not took reasonable care to ensure I'm paying the correct amount of tax?

Another thing I noticed is the total amount of PAYE income on the P800 is £29463 plus £3239 for car benefit and £3042 for car fuel benefit, however my total income for the year on my P60 is £24204.39. Should the total income on the P800 be the same as the P60?

Any help on this would be great.

    Did you have the car / fuel benefit also in 08/09? Or is it new to 09/10 .......... where the P11D would not typically be with HMRC until July 10.

    The car / fuel benefits obviously don't figure on the P60. But the discrepancy on the other values looks large. Pension contributions?

    The P11Ds for 09/10 have to be submitted in July 10, so this is presumably HMRC using the information provided by your employer.

    Pay is pay, and benefits are benefits. Your P60 does not show benefits, that is the purpose of the P11D.
  • Yes the car/fuel benefit was new to 2009/10 and my company did make a contribution of 3% of my salary to a pension fund.

    For 09/10 with the 'benefits in kind' being new to that year ..... there's no chance of asking HMRC to consider this as 'official delay'.

    But you need to reconcile the discrepancy between the P800 taxable pay figure and your P60. If you're certain the £29463 excludes the car / fuel benefit then there's a discrepancy of over £5k. I'm not quite sure whether you approach your payroll people or HMRC in the first instance ...... but you need to resolve it
