Not Declared on Council Tax

Hi,

I'm hoping someone can help me. On March 18th 2010 I moved back in with my mother after walking out on a relationship but have just found out that she has not declared me with the Council Tax bods. I also found out that my ex never declared me either and has been receiving the single person discount for the last 3 years despite me giving him money towards the bill. Can anyone tell me where I stand regarding this and who is liable???? I really don't want to get my mum into trouble but I am looking to move out of her place in the next 6 months and the Councils form insists on having my previous address. I don't mind writing to them and explaining what happened and settling whatever the balance would be but that would open up a whole new can of worms with the ex regarding the payments, the only evidence that I ever lived with him are my pay slips as he paid all the bills and I never changed my address with my bank. Will the council hold me liable for him not declaring me??? I gave him 300pcm to cover the bills (CT, elec, gas etc) and also covered most of the food costs.

Any help/advice would be much appreciated.

    When you lived with your ex-partner then you should have been jointly liable for the council tax due, however at present , as you are not named on the bill then they cant currenlty take recovery action against you. Should they find out though then they can issue an amended demand notice showing you as jointly liable and then proceed from their. Any agreement you had with him does not affect your liability under council tax legislation.

    In your current property, assuming your not a joint tenant/owner, then your mother is the person liable for the council tax and the person who would be responsible for re-paying the 25% discount that has been incorrectly awarded. You are not personnaly liable for this charge.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
