''Joint' loan with my name but his date of birth

I have been in a debt management program for the past 5 years, the last debt I have left on it is a Welcome finance loan I took out with my now ex husband in 2005 for £6000ish (the loan now stands at £3000).

When I left him and sorted out all my/our debts, the company told me that at some point his name had been taken off the loan (we re-financed it a couple of times, it started out as a small loan and got bigger and bigger) and therefore it was wholly my responsibility to pay and I didn't stand a cat's chance of getting him to make payments.

I was just having a sort out of my credit files and noticed (don't know why I didn't notice before) that although the loan has my name on it, it has HIS date of birth.

Does this mean anything? Can I go back to the company and get them to chase him for payments? I have already paid back the other loans, catalogues and credit cards that he ran up in my name (7k worth), it would be fantastic if I can shed some of this one (the big loan was for a van for his work).

Or will they just say it's a clerical error? As far as I knew it was always a joint loan, by the way, I certainly never intentionally took it over.

Thanks in advance for any help.

It is usual for all parties to a joint loan to be "jointly and severally" liable for the debt. This means you are both equally liable and the creditor can pursue either or both of you for settlemnt of the debt. Since you are already paying up, it is easier for the creditor to continue to pusue you alone. They really don't care who pays as long as the debt is paid.

Which date of birth appears on the agreement is probably irrelevent in this situation.

I regret that it is my opinion that you are stuck with the debt.

  • Thank you for answering.

I'm wondering really if I have any grounds to say it's still a joint loan, and to ask them to contact my ex for payment as well as me. I was gutted to find out that his name was no longer on it, and in fact I only started out as a guarantor (back in the hazy days of having a squeaky clean credit rating). I think I am probably clutching at straws though.
  • sorry but you are.
  • Lol, thanks!

    Back to the grindstone then.
