Lowell Financial- Advise needed!

Hi there

Any help would be appreciated...........
My husband received a post card type thing in the post saying that someone was trying to contact him. It didn't say who they were and so it was ignored.

2 weeks later and he gets a letter from Lowell Financial saying that they are trying to contact him about a previous address which he had lived at. There were no further details about what this was, so my husband emailed them and asked them what this was about.

2 weeks later there was an email response saying that it was an error and not to worry they had been chasing the wrong "debtor" and this would not affect his credit rating and they would remove his details fromtheir records.

He emailed back expressing concern that he had never once been told that it was a debt but was pleased that it was an error, but that he had also checked his credit file (experian) and there is big red letters was a default registered to Lowell Financial and so he asked for this to be removed.

A further email was then received the next day saying that the previous email they had sent telling him it had all been an error and that he was infact the correct person...see email as follows

What is the copy statement and agreement that they talk about ?

Thank you for your recent request for more information regarding the above account, we have requested statement and agreement that relat to account xxxxxxxxxxxxx previously held with Capital One and with outstanding balance of £451.32.

we can confirm that the last payment made on this account was for £100.00 this payment was made on the 21 May 2003.

We have requested copy statements and agreement from Capital One which will be forwarded to you upon receipt by email. Please note an acceptable payment plan will be required once the statements and agreement is received.

    It seems typical of the underhand tactics that many Debt Collection Agencies employ.
    Firstly, is Lowell Financial telling your husband that he owes the money to them, or that they are collecting on behalf of Capital One?
    I wonder whether a Court would accept that their second letter was an 'error'.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    They haven't indicated either way if he is owing money to them or capital one. What does that mean?
    All communiaction has to be done in writing as my husband can not use the phone.
    This is making it all a very drawn out process!

    I would hold off until the copy of the agreement is sent to you - is this an old debt that got forgotten about? It's not a huge amount luckily, so hopefully if it is his you'll be able to get it cleared fairly easily.

    The agreement they're talking about will be the original signed credit agreement & the statement is presumably the last statement issued by Capitol One.

  • He really cant remember if this is his debt or not! We are unsure if he ever had a capital one card.
    Luckily it is an affordable amount for us to pay back, but it all seemed too strange....First the relief that they said it was an error and then the retraction of that saying that he did owe the money!??
    If they have this proof that they talk of, of course he will pay it back but its all a bit strange. I suppose we will have to wait and see.
    The emails that they have sent are also littered with spelling mistakes, so I wasn't sure about it all at first.
    How will they email a copy of a signed credit agreement? That is what they have said they will do...

    If they are saying that you owe THEM, then it would appear that they may have purchased the debt from Capital One, but you can inform them that 'you acknowledge no debt to them and that they MUST supply you with a true copy of the original signed credit agreement. Failure to do this within a certain period, will make the collection of the 'debt' unenforceable.
    It is, in all honesty, best to deal with people like these in writing ONLY - you only need read through these threads to see how many people's lives have been made a misery of by the constant telephone harrassment of Debt Collectors.
    Additionally, should this matter ever get to court, you will have a record of all communication, if done by letter only.

  • Ok thats good to know.
    In the letter that I put in my original post I don't think that they actually say that hubby owes THEM money or capital one? It says " an account previously held by capital one" What would that mean?
    All correspondence will have to be by letter/email as hubby is profoundly deaf (can't hear or speak) and so they would not be able to phone him anyway (or the other way round!!)
  • Interesting comments about Lowell. I am having trouble with them at the moment claiming they have not received money which I know my bank sent. I agree about the badly written and spelt letters. I think they must be cowboys. They are very disorganised and rude and seem to rely on harrassment and threats continually. I have been trying to get their e-mail address to contact them without success - if anyone has it I would be grateful.

    They must have purchased a job lot as i had a postcard too!

    On delving into the situation, getting my credit report etc i found that my debt to capital one was paid back in 2000 I only ever had one account but funny that lowell are now trying to convince myself i had 2 acc opened on the same day with near identical acc numbers.

    As far as you can do all correspondence in writing, do not at any point admit that you owe the debt and give them a set amout of time to provide you with documentation. If they cant provide info tell them politley to walk off a bridge!
