Hello everyone.
not sure if i am in right place, as i am a newbie!
my hubby has had a problem with a bank loan, he got behind with repayments after being made redundant, after fruitless negotiations with bank, they put charge on property. ever since thn we have been harassed by a company called ascent, even when hubby was seriously ill in hospital, they wanted me to get him to sign a letter to say i could discuss his debt with them. my question is, if they have charge on property, then why are they still in pursuit of repayment by other method (ringing twice daily), and isn't it slightly out of order trying to get a signature from a seriously ill person, sorry if this is a bit long winded, i would appreciate any advice. thankyou

Assuming the bank has the charge on the property then the debt collection agency would seem to be acting for the bank.
Write to the bank complaining that their agent is harassing you personally, telephoning at unreasonable intervals and trying to force you to pay an amount that you cannot afford - all in breach of the OFT guidance. Send the letter in the post and get proof of posting (free from the Post Office). Hang on to both that and a copy of your letter.
Alternatively, look up the bank on the FSA Register and see if there is an e-mail address you can use.0 -
Check that Ascent are really acting for the bank. If the bank has a charge on the property, why would they need to employ sleazy debt collectors?
Do not under any circumstances sign anything from Ascent. Deal directly with the bank. Many of these companies find out about debts and then ruthlessly terrorise people. They usually get paid on a percentage basis if successful."Never underestimate the mindless force of a government bureaucracyseeking to expand its power, dominion and budget"Jay Stanley, American Civil Liberties Union.0
