Not being funny but it appears somewhat irrelevant at the moment unless the OP can magically find the money to go bankrupt or get it sponsered by one of the charities if this isn't the case then the OP needs to carry on as best they can and get the benefits sorted first off.

That is really sound advice and quite right, before thinking about doing SOA's can the person stump up the fee? Admittedly it could be reduced from £612 to £462 if form E160 applies, but that's still £462 to find.0 -
Yes, I do have money for the fee (just about) . No I do not have enough assets to pay my debts or any part of them (I wish) - in fact I have no assets whatsoever in any shape or form.
No, I do not want to wait for the time when I may/may not find another job as this may take a very long time and in the meantime the worry is just too much.

If you complete the form properly, show the court you have taken professional advice, cannot pay your debts and pay the fee I cannot see them having any reason to refuse, I would be interested on your rough guess to final debt amounts you are going bankrupt for though.
The fees go to the court and you don't get them back.0 -

Fair enough - in that case - you need to find out the procedure at your local court - some have an appointment based system where you might have to wait a month or so, others have a turn up on the day system. As long as you have taken advice from a debt charity.

Right, just had a chat with CCCS and was told my BR application would not be accepted by the court as firstly I would have to prove that I can live on theat £65 per week.
That baffles me a bit as lots of people do, that is why the JSA is set at this level.
I was told to write to all my creditors and ofer them token payments of £1 per month for the time being and perhaps apply for BR later on - if I do not find a job in the next few months.
Not the kind of route I want to take really - can anyone comment on this please from your own experience?
It does not make sense to me to be honest...

Start keeping receipts for everything, stop paying mobile and Sky, let them get cut off and start putting your money on essentials. Prove you can afford to live on that amount of money.
Also have a chat with another debt charity helpline and get a second opinion, I think once you have demonstrated through your SOA and keeping receipts also that you can live on that amount of money you wouldn't be turned down for bankruptcy. Cut all your credit off now, live as if you had just been made bankrupt from today onwards, keep a track of it, keep receipts, write a diary of what goes where, do this for a month.0 -
I do not have any credit available, do not have any credit cards/overdrafts etc.
I will be calling CCCS again on Monday but this time it will be their BR section I will insist on talking to.

You wouldn't qualify for this anyway as I think the interview has to be more than an hour from home. Yes it was a pain in the !!!! having to go to the job centre before interview and at short notice.

You need to be long term unemployed so you will need to wait until you are on Income based JSA after 6 months. It makes sense as they need to be sure you aren't just going to get a job in a few months most people get a new job very quickly after losing a job and some people take forever. Why do you need to go BR right now? If you have no income the creditors will not harass you(well not too much anyway). Simply say to them I'm unemployed and can only offer £1 per month. They cannot get money from you if you have none to give.
