Hello, I'm new to this so please be patient. I had a letter today from Wescot Credit Services on behalf of MBNA for £1,445.94! I hadn't heard from MBNA in over 6 six years, and after seeing loads of advice from you guys about this company we called them and said about Limitations statute, they even confirmed that last payment made to MBNA was in August 2000 so over 6 years now. They said they couldn't send dept collecters out to us but would call and write until we basically give in!!:shocked: So would appreciate advice from anyone on what I should do?

  • Threaten THEM with legal action - they are harrassing you!
    I've had no dealings with these people other than a letter I received from them a week or two ago for a person not even known at this address.
    I insisted they took my address off their database/files and that if I had any more correspondance from them, then it would be forwarded to my solicitor. Heard nothing since - they really are unpleasant morons!

    i think that would be called harrassment. You need to to write them a letter and say as such and then go to your local CAB for some more advice. good luck MMM xxxxxx

    Do NOT respond to Wescot. Ignore them. They are just a bully boy company who buy old debts off companies and then send very threatening letters to people to intimidate them into getting you to pay them money. Please ignore them and they will go away.

    Do you actually owe money or is this an out of the blue threat?

    In other words, have you enjoyed some extravaganzes, i.e freeloaded at the rest of our expense or are they simply bullying you?

  • Over 6 years ago when I was a stupid 18 yr old, but paid off other depts and thought had paid this one as well as had not contact from them until this letter

    then you need to talk to them otherwise they'll proceed and you'll find yourself with a CCJ which will mess your credit history up.

    Find out what you owe and arrange a repayment plan.

    It's irrelevant when it's placed before a District Judge.

    I assume this is a sub £5k claim?

    In which case, the procedures are ****very**** informal because it's dealt with via the Small Claims Track of the County Court; all they need to do is lay before the Judge the claim (they can safely leave dates out of it) together with their evidence (I assume it's a credit card debt in which case your signatures on the relevant slips will be enough) and you'll have to convince the Judge that they're not your signatures on the said slips.

    Once they have judgment, they'll send in the bailiffs.

    They can't touch you after 6 years,ignore the threats.
    Do a search on the debt board for advice,or look at http://www.nationaldebtline.co.uk/
    Sadly there are people on here who try and worry you as much as this lot.
