non payment of csa for 7 years.Ex partner is working the system in his favour

Hi,I just wondered if anyone had some advice on my csa case.Dec 22nd 2002 i contcated the csa as my ex partner was not paying anything towards his son.After years of him ducking and diving the csa.(he has changed his address,job more times and has varying degreees of unemployment).The csa managed to get a liablity order for £5,000 (Jan 2008).The csa then tried to enforce the order at least twice to my knowledge but to no avail.After the enforcement action he went on the dole. Then came of the dole after a few weeks (i nor the csa was aware he had come of the dole and he had then a zero assement in place)the zero assesment was in place for 9 months and yet again when the csa started chasing him again he went back on the dole,then after a few weeks he comes back of the dole.To cut a long storty short the next action to be taken was commital to prision nov 2010.Yes you guessed it he went back on the dole so the csa could not do anything........ as a judge would see he had no income so no commital to prision............

He is a kitchen fitter so is self employed......
He lives with his gf and her children and they CLAIM they dont live together.... but they do
He has an 08 plate van .....and a freelander
He has repetedley said he will not pay maintenace full stop.......

I feel he is using the benefits sytem to aviod payment.I am aware that you have to fit the SAID protcool to obtain benefits..... but every time the csa get close he goes on the dole......he has through the years been on and off the dole like aa yoyo .....so many months of mainteance can not be asseseed....

My actions so far.....
I have tried to sort the matter out with him ...he just laughs thinks its funny....
I have reported him for working (as he is still working when he is claiming)and claiming benefits and living with his gf...
The csa are aware of the problems but until the benefits agency finish their investagtions (which can take up to 18 months)their is nothing more they can do
The benfits agency are also aware that he is using the system to his advantage....

Im not after revenge for anything i just want him to pay for his son (who through his choices he does not see) my son is disabled and im a student nurse i just want other peoples opinions on my next course of action.........i do think that the benfits sytem is so wrong in this case......me and my son have waited over 7 years for aminteance and im not sure if its worth the effort any longer...
Any ideas or opinions would be appreciated

    I have 2 children and have been trying to get maintenance from their father for several years after 5 years with the csa and even getting as far as enforcement they still dont think there is any hope of me getting any money from the father of my kids. To top it all of he owes me approx £21,000 over the period of non paymenT. My son has just moved in with his father and I get a call from the CSA to say that the father is now putting in a claim to get maintenance off of me. Im re-married but claiming dissability allowance they said they will settle within 8 weeks and take money of my dissability to pay the father.... Im speachless and cannot believe that the csa are doing this, they have told me that the case which is in enforcement is nothing to do with new claims, so now not only does he owe me a lot of money but Im going to have to pay him now or take the risk of going to prison, why hasnt this happened to him already why hasnt he had to settle this debt its so un fair, Im so angry and have had MP involved who did get a response but still nothing has happened from the CSA. Somebody please help :mad:

    There *is* some good news, once the new case is up and running you will be able to ask the Csa to refer the case to their off-setting debt team, unfortunately this can only happen once they work out how much you should be paying.
    I can't believe the balls on some people, to put in an application while owing so much. The Csa don't have a choice when it comes to new applications, they have to launch a new case. Believe me, the staff will be on your side. You need to ask them to contact the team holding your other case and ask them to do the chasing for you.

    I cannot understand how some fathers can be so downright awful when it comes to the financial situation of there kids...! This sounds like one of those that needs taking out and being shot...! I have no sympathy for him, when they eventualy catch up to him for the debt, and i hope they use every power in the book to enforce it as well... What he is doing is callous to say the least, settle your own debt before you start claiming you need maintenance...!!!

    I've probably only seen it happen two or three times, but it is very very annoying. From what I've seen, this won't happen with the new scheme, the offsetting will happen straight away and there will be less hassle for the parent owed all the money.

    ah, so not as brazen as perhaps they might be?! I have considered the possibility of my ex going down this route at some point in the future as I feel quite sure there will be pressure placed on the children to live with him as soon as he feels they are old enough. Good to know he won't get away with it.

    No, it's not that widespread thankfully, but it sticks with you when it happens.
