What type of Solicitor do I need?

I have a mortgage in my name which my partner is keen to pay off for me as what we will pay in interest is more than what he is earning in interest on his savings.

What kind of solicitor will I need to draw up the agreement of this? ie percentage of home he owns etc

I have googled for information however a conveyancer just doesn't seem right to me.

Anyone else been in the same position please?

  • From what you describe, you want an equity transfer to 'tenancy in common'.

Supporting this with a 'deed of trust' may well be advisable.

Any conveyancer (licensed or conveyancing solicitor) will do the first - proabbly best to utilise a conveyancing solicitor firm if you require the second.

Thanks very much, I will telephone a few and make an appointment. However with not really knowing what it is we want/need we are going in blind so to speak.

    Thanks again.

I have now spoken to a solicitor who said we need to settle my current mortgage and then set up a mortgage from my partner to myself for the amount he is paying. It will show no interest payable and no payments to be made. This all sounds very confusing to me, is this right do you think?

The property is worth approx £110k and my outstanding mortgage is £42k with around 16years left to run.

Partner and I aren't married and house is in my name only. He wants to pay it off as we will be paying more in interest than he is getting on the savings and so see's it as the best option.

We are trying to cover the 'problem' of if anything were to happen with our relationship in say 10 years time (would hope to married then though!).
