Council Tax banding appeal

I am currently in the process of appealing against my council tax banding.In the defence of their decision they are comparing my property to others 10 miles away. The only house in the same village they compare me to is my neighbour who is also appealing.The letter from VOA bases its decision on the size of my house ,and the fact that I have no garden is of little impact on its value.Consequently i am in the same tax band as houses that have tennis courts bigger than my house and plot, 2 are so far away from the road they couldnt be seen when google visited,another has a helicopter pad.2 were so large they have been used as hotels.Whilst i believe this to be nonsense what i am trying to establish is whether i have any rights to be compared locally.I believe that they have to take into account the negative aspects of the property which they have not done.I have asked for the sales data for 89-91 which they have refused me ,but may decide to use in which case they'll notify me of what they are using.Has anybody else had this sort of response from VOA (East Midlands)?
