Bailiffs en route now!

Just had a call from my best friend saying that her other half's mum had called them saying that the bailiffs were on their way round to pay them a visit as they had called at her house and she gave them their new address.

I asked if they knew what creditor it was for, they dont know..... its Moorcroft whose out to visit them though so I guess its the company they have bought the debt from.

Her partner has a payment plan with Payplan but she believes he missed last months payment.

What can she do as its happening as I post this....... obviously i've suggested close all windows and doors etc but we need to know their rights etc!

They are both so worried!

    from what i've read on other threads here you don't have to let them in. if you can find mcbirnies post of the oter day i believe there was info in there re: baillifs.
  • i believe only court appointed bailfs who are coming for unpaid council tax etc can enter the house tell them to speak to them through the letter box do not open the door and lock all windows
    current debt standing at 27500 :eek:

    oh and i owe 8 grand student loans 2 :mad:

    still owe the student loans ha ha :p
  • Hi not an expert and hope someone who is will answer you soon! As far as I know you do not have to let them in, close the curtains lock doors make sure windows are all closed, they cannot levy on what they cannot see.Hope they can hide the car and any outside stuff that they may be able to see.Do not allow them to bully you, refer them to payplan.

    No bailiffs can force entry except where they have previously been let in and have levied against goods.

    Local councils (unpaid council tax) use private bailiffs. Court bailiffs service warrants of execution on defaulted CCJs.

    If neither scenario applies, this is probably some jumped-up debt collection agency scare tactics.

    If he's got a DMP with Payplan and he's missed a payment wouldn't it be best to go back to them asap to sort it out?
    You should never call somebody else a nerd or geek because everybody (even YOU !!!) is an
    "anorak" about something whether it's trains, computers, football, shoes or celebs :p :rotfl:
  • Moorcroft are vermin, and are the DCA i haaaaaaaaaaate the most.
    They have no rights. Do not let them in, tell them you have contacted payplan, who are now resolving this matter for you. Tell them this through the door. Then tell them if they dont remove themselves you will ring the police because they are intimidating you which is a breach of the oft guidance on debt collection.Really do call the police, they have confirmed it is harrassment.

    I will bet you 50p they don't turn up anyway.

  • I had the bailiffes round my place a couple of years ago luckily I was out at the time but was horrified on my return that they had been ( they left a card or letter cant remember) it was for an outstanding bill with british gas I didnt even owe! I dread to think what would have happened had I let them in, all was resolved in the end took about a year though, but my advice, ignore their bully boy tackticks, do not open the door and seek advice asap as to where you really do stand, lots of luck.

    Moorcroft are NOT Bailiffs. They must not claim or give the impression that they are. Tell your friend not to open the door to them in any case and to go to CAB in the morning.

    as above...Moorcroft are only debt collectors....they are not bailiffs...
