When is a contract formed?

Hi all,

Im hoping someone can give me some quick law advice.

I signed up for an ISP last November for a 6 month contract. I then decided to renew my contract before my old one expired (May-November 2005). I did this on the 6th February. My ISP requires money up front and therefore money was taken from my account on the 9th January.

Today (16 Feb) I got a better offer from another ISP and was wondering if I am in my rights to cancel. Normally company policy for my ISP is take half the money back which isn't enough for me. Anyway Im interested in the Distance Regulation thing which allows me 7 days cooling off period.

It has been more than 7 days since I signed up but exactly 7 days since money was taken. Therefore I am wondering whether the contract starts on the day that I renew or the day that money was taken.

Any help would be great thanks

  • Under law the contract has already been formed. What you need to know is what the cancellation terms are.

    For example if you are allowed to cancel with 28 days notice with a full refund, you would be OK.

    Thanks for the reply :) A few question:

    A agree a contract has been formed, however Im not sure WHEN it was formed, when i clicked renew or when money was taken? Im hoping its when money is taken because I should then be able to cancel because of distance regulation.

    However, cancellation terms is that they will refund the money minus 3 months cost which is basically half my money.
  • Offer and acceptance.

    They offered you the contract. You signed it. If you posted it back to them the contract started on the day you put it in the post box.

    Wouldnt worry overly. Ask them for a refund and see what they say.

    was over the internet actually and they refuse to give all the money back, just half :(
