They've sent me a letter today stating they've been instructed to commence county court proceedings against me unless I pay the full balance (4K) off my account.
I've already told the creditor I can only afford to pay a token payment every month, commenced the payment, and sent a personal budget, etc.
What are the chances they'll go through this process in the courts? I've stopped toalking to the creditor months ago after threatening phone calls, merciless people, etc.

If you have been dealing with them for a number of months then they may be serious about taking you to court. However, this could be a good thing for you as the court will set a payment that is affordable. You should ask to move the hearing to a local court, go along and give your details in person, let the court know you have been communicating and that they have breached OFT guidelines regarding harrassment. You then ask for interest to be frozen, which the court quite often grants.
HOWEVER. You haven't given any background about the debt. If you own your own home and the debt is large (5000+) a CCJ is more serious and could be the start of the charging order process. Please post more info for more detailed replies.
