Hi,
I've just discovered that my debt to pounds2day has been passed on to clarity, I was advised by Payplan to suspend payments to pounds2day as they were unable to tell me which DCA they had authorised to collect payment (I had THREE contact me saying it was theirs!) and to write to pounds2day, I have never received anything from them but have now received a letter from clarity.
Well I got a text last week and assumed it was realting to another debt that is currently with clarity, so I called and was shouted at on the phone by the idiot who answered... why did u default on one month loan etc why can't you pay back three times what you originally borrowed (which is what it stands at now), anyway they claimed they had written to me but I havent recieved any letters so Iasked them to resend the letter.
It turned up yesterday and I have scanned and forwarded to payplan to deal with, however clarity keep texting me telling me to call them, I have no idea how they got my number (as its withheld on my mob), the letter was the standard pay us £300 and we'll leave you alone, or we will arrange payment plan or we will take you to court, send someone to your house, or go for legal action.... burn down your house, take your firstborn child, eat your pet rabbit... sorry got carried away there lol! :rotfl:
anyway should I call them or not? I don't usually as a rule, but it is going to be a while until they receive paperwork and monies from payplan?
It does say on the letter ''where this agreement remains legally enforceable, recommending to our client that their solicitors be instructed to commence legal action against you'' what do they mean legally enforceable?

Personally I wouldn't call them - not least cos they are bound to start shouting again. And no matter what you say it won't make any difference (as you are not going to be actually paying anything to them).
You could try sending the contact me only in writing letter to them - but again that will take a week or so to process. Might need to amend to specifically refer to texts as well as calls? or use the DPA bit to get the to stop using that number at all.
Is there anyway to block texts from them on your mobile at all?
Legally enforceable - well it sounds like they know that a lot of debts they deal with are not legally enforceable (either because they never were or because they buy lots of very old statute barred debt). However as yours is a recent payday loan sadly it would almost certainly legally enforceable. To be honest putting that paragraph in just shows them up to be the muppets that they are!

Thansk Tixy, I've just fired off an email saying I am with payplan, please be advised they will be in touch, but also that I don't want them to call me as I will not discuss it on the phone, under the DPA! I would never normally consider calling anyone but i was kind of wavering and you've made me see sense! :-)
I will follow this up in a letter, but thought it might get them off my back til christmas! I've worked too hard this year to spend my time off dealing with muppets! :-)
with legally enforceable thats why I was confused! cos Its fairly recent, so def not statute barred! they are fairly stupid to be honest! the guy I spoke to last week when they first contacted me said he didnt know who payplan were and they werent able to deal with them on my behalf..... which is obv why they have been happily accepting payments and offers of payment for the other debt of mine they have!
