Redundancy Payments & Bankruptcy

  • I am in this situation primarily because my ex husband ran up all the cards that were in my name (he had a CCJ and couldn't get them in his name) then left me for a russian prostitute, that he put on my credit card too.

He then screwed me financially in the divorce so I got nothing but the debt.

The redundancy payout is a sixth of what I owe, so it wont be enough to offer as a lump sum settlement. Believe me, I've thought about it but I know its not enough.

The guy I have been talking to about my BR said he has had people go on holiday whilst they have BRs going through and it shouldn't be a problem.

I am not trying to take the pee, believe me.

I am making token payments to all my creditors and will not go on a hugely extravagant holiday and all my other bills will still be paid.
  • Sounds like you've had a tough time so first have a hug :o.

I think part of the problem is that there doesn't always seem to be uniformity in the way the or treat similar situations.

Personally I went on a weekend away before I went br but I didn't hand on heart know I was going that way. Nothing has (yet) been said about it.

I think the risk is that the or deems it as irresponsible and pushes back your discharge date.

From a wellbeing point of view I totally understand why you would like a holiday but it's a case of is it worth taking a chance. :(
  • my parents paid for me to go away for a few days, went to a caravan down on the south coast just for about 4 days, I needed to get away from things to get my head straight. I then went back and got everything sorted, moved out of the house and went BR 10 days later.

You don't need to go somewhere extravagant to get a break, and I'm sure a budget break wouldn't be out of the question

Most who go br spend more then they have coming in, are you br?

No. I was making the point about taking responsibility now the OP has some money coming in.

Although I accept it is a judgemental statement, it's truly meant about taking responsibility and highlighting that you can't just take the fact that BR allows a (semi) clean slate without doing as much as you can towards reducing the amount that companies will be writing off - which we all have to pay for in the long term.

Don't disagree in principal. The OR's job is to ensure creditors are recompensed as much as possible (after their own fees have been paid of course)

I think you have to bear in mind the stress and strain that people are under when making the decision to go br. A lot of people I talk to suffer from anxiety/depression.

BR is also about getting your life back.
  • Why tell them you went on holiday - tell them you were investigating a change of life / prospective work :-). I know we should be 100% honest but you need to luck after yourself :-)
