I'm sort of stuck & confused atm as to whether sending a CCA will be of any use as I have made contact with them, confirmed my details, arranged a payment plan & made payment.
Well, I was on the same situation as you are right now,
First step, send the CCA request letter as soon as you can, recorded and digitally signed.
Cancel DD, you can pay them by internet banking, like I was paying them, you only need Account number, sorte code and reference number.
Do not call them anymore, keep all contact to writing, if they keep calling you, and you know its them, do not answer, and if its after answering the call, then hung up. Send letter template for phone harassment. And keep cool, relax
When I said I was on the same situation, I did arrange to pay them a few years back the same way as you are doing right now, thay wanted DD, I told them I only had a sinple account, and could only set it as internet banking, bla bla bla, they took it fine.
I'm still waiting for my CCA, so not paying them at all.
So, do your CCA request straight away0 -

Thanks for answering me & putting my mind at rest
So I do need to keep up payments still?
If I send out the CCA letter this week, do I sign it or put my post code on it? (on the recorded delivery return to sender label) I read that you shouldn't put your signature on paper work/letters.
How do you digitally sign something?
Spoke to my mum as it's her account from which the money owed is debited from & she says that no payment left the account for Dec. I told her not to reinstate the DD payment, just to confirm with the bank why it has been either cancelled or not debited for this month.
Would my mum have to set up the internet bank A/C? I definitely will not set up any account in my own name.
I assume I would need to send a letter to confirm that the payments are to be taken from the internet banking A/C (with relevent details) & start paying again until I receive a reply to the first letter if at all?0 -
Do what everyone has suggested and set up a standing order. That can be done by phone, internet or in branch. Thanks for answering me & putting my mind at rest

You need their bank account number, sort code number and reference number ( for the debt to make sure it is applied to your account) Once the standing order is set up you make the payments.. I have standing orders for my water etc and I go into my account once a month and pay them what was agreed or what the oustanding amount is. They can not take money..You give it to them.
You don't need to tell them that, you just continue to make the payments as agreed.

When is the due date?? you could do a payment now, to keep the happy, while you request your CCA, remember the 12+2 days after sending CCA request, after that delay, you stop paying, is then that it became unenforceable unles they send the CCA to you.How do you digitally sign something?
Just print your name with your word processor as My Name ie Joe BlogWould my mum have to set up the internet bank A/C? I definitely will not set up any account in my own name
Well, if your mum is using internet banking, she could set the payment as an internet banking payment of a bill, as I said you only need Acc number, sorte code and reference to set it up.I assume I would need to send a letter to confirm that the payments are to be taken from the internet banking A/C
No they can't take it, you pay them, you are in control of when and how you pay. Just ask them to tell you the acc# sorte code and reference to where the payment should go, periodstart paying again until I receive a reply to the first letter if at all?
As I said before, you send the CCA request, recorded, from the day the letter is sent, they have 12+2 days to reply with the copy of CCA if they have it, once the 14 days elapsed is when you stop paying, and send the reminder of CCA request0 -

Brilliant thanks very much. I'll get it sorted now. I'll get a letter typed up requesting their bank account details to make standing order payment into, from the internet bank A/C.
I'll also send the CCA letter at the same time, both sent by RM rec. del.
The payment was due for 2nd Dec which seems to have not been debited.
I'll see if I can get the agreed payment sent to them today. I assume I'll have to do a card payment over the phone?
Sorry about so many questions but I'm new to this & learning. I want to make sure I'm doing everything right.0 -

I don't need my own A/C as my money goes into my OH's (not joint) & I definitely will not be opening one in my own name.
They refused a standing order when I originally suggested it (also monthly over the phone card paymets). I guess it's because I would have been in control of the amount of money they can have access to.
Maybe I can do an automated payment over the phone without speaking to someone...0 -

Don't do that, they will have the details and could take more or serve themselves to the money.
If you call them just tell them that your credit card has just been cancelled, and the only way to pay them will be through internet banking and you need the details in order to pay them, nothing else, they will try to bully you etc etc, just if they do not want to give the details, hang up.
Your mum could know the account number and sort code where the DD was going to, if she ask the bank, I do not think that is against the DAta protection act and that way you could make a paymentSorry about so many questions but I'm new to this & learning. We've all been on the same situation once, no worries0 -

I just spoke to my mum & she's due to go to the bank today so she will ask for their A/C No. & sort code for 'future payments' (by internet banking) & see if she can send an instant payment off to Lowell Group/re activate DD or standing order for the mean time. I would rather they received a payment asap so they can't say I've refused to pay them.
*EDIT: obviously I'll call them like you said if the above isn't possible*
Then I'll have time to send in writing about usng internet banking (hopefully I'll have their bank details today - if not I'll request them in the same letter) for 'future payments'. At the same time I'll have also sent off the CCA letter anyway.
Then like you say I'll wait for a response about the CCA letter & if I don't get one I'll stop all payments. (regardless of me requesting their bank details to set up internet banking payment). ← that's the one they'll probably respond to first though.0 -
Forgot to mention that as it's not my A/C the payment will be made from, they may not accept it over the phone, without my mums consent etc. Only reason I mentioned about re-instating DD or SO.
Thanks very much for all the advise, it's really appreciated.0 -
According to the bank manager the DD is still set up on my mums account & Lowell Group have not collected payment? That's why it didn't show up on the Dec statement.
He said he doesn't know why, but there's no reason they can't?
The bank manager also said that Lowell Group cannot take more than the agreed DD amount per month.
All I'll do now is send the CCA letter off & go from there.0
