Annual Holiday Entitlement

Im a first timer to this, so be gentle with me!

I have the feeling I am not getting the correct number of holidays.Can some one please advise me if this is so.

I work 5 days a week and my employer tells me I am entitled to 20 days holiday, but as a "generous employer," they give me 3 days extra making 23 days.

On bank holidays, if I have to work, they pay me double time. If I dont work, I get the day off with pay. The government web site which calculates holiday entitlement says I should be getting 28 days holiday. So, am I being short changed by 5 days holiday?

    The holiday entitlement is 28 days which can include public holidays. So if for instance you had 23 days holiday and 5 public holidays you have got your entitlement.

    NO.. 20 days plus bank holidays .. you work bank holidays you get double time .. if you don't you still get paid usual hours Bank holidays add up to another 8 days. You also get another 3 days paid holiday on top of this?

  • If you work 3 or fewer bank holidays, you are getting at least the minimum statutory paid leave entitlement.
    If you work on 4 or more bank holidays, you are not getting the minimum.

    Your statutory requirement for holidays is 5.6weeks which can include bank holidays therefore if you work five days a week you are entitled to 28 days (20+ 8 bank holidays)
    The basics of holiday rights

    There is a minimum right to paid holiday, but your employer may offer more than this. The main things you should know about holiday rights are that:
    • you are entitled to a minimum of 5.6 weeks paid annual leave (28 days for someone working five days a week)

    you are entitled to 28 days off which can include bank holidays, if you work a bank holiday your boss can pay you extra but he doesnt have to, you cant be paid extra to give up your holidays.
    does your boss give you 20 days plus a day for each bank holiday you work plus the unworked bank holidays? if so then you are getting 28 days

  • Thank you to all who responded to my post. I would say that I worked 3 of the 8 bank holidays last year, so I suppose I am getting my 28 days holiday in a round about way ( 23 days holiday + 5 bank hols).

    NO.. 28 days (5.6 weeks per year) (work 5 days per week) which CAN (but doesn't have to) include bank holidays.

    If working bank holidays is a regular practice it sould be sensible for the employer to include BH in the overall entitlement and use them up for the days that are not worked.

    This way they/you don't have to keep a seperate count of which have been worked.
