HFO services chasing Barclaycard debt help please

Oh and by the way, you post states they have you employment details , make it clear in writing that it is against the law for them to contact your employer and if they do so, you will report them to the relevant authorities.
I happen to know through sources that HFO are being investigated by the OFT at the moment.
"The letter goes on to say they will seek a CCJ against me and once that happens they apply for a Warrent of execution for court bailiffs to seize my posessions or alternatively apply through solicitors for an order to obtain information against me." - This is a million miles away at the moment, even if and I mean If they eventually obtain judgement against you. Just a threatogram so ignore
Get all the information from your CCA request and Sar and then we can pick the agreement/application apart and their dodgy interest and charges. Also remember it is against the law for a DCA to intimidate you into making payments you can't afford, to use misleading threats and never send them an income and expenditure sheet, only a judge has the right to make you do that

Yes sorry, shouldn't of used the word we, but I get quite worked up on the subject of HFO. There are DCA's who just do their job and do it within the law and there are others who operate outside of it. Anyone who has read Tony Hetheringtons news paper article about HFO, would know the story of HFO phoning someones neighbour about a debt they owe and suggesting that their neighbour buts a note on a brick from HFO and chucks it through their front window, will know how low some of the DCA's tactics are. I have first hand experience of HFO and tatics they use and have reported them no less than 4 times to the OFT and once to the police.
Ok , I don't advocate running up debts and not paying them off, but peoples circumstances change, often not of their own doing. But lets get one thing straight, Lifeonloop has never at any point run up a debt with HFO. HFO choose to buy this debt from Barclaycard at around 10p in the £1, they then pile on hefty charges and interest which they are not entitled to and then send letters to frighten people into paying it. A lot of people probably end up paying it. HFO are fully aware that these debts are sub prime and if challenged may not be enforcable, yet they still buy them.
The methods they use to collect often break rules in which they are allowed to operate which is why finally they are being investigated by the OFT, the results of which could see them lose their consumer credit liscence.
HFO services also use their company HFO capital to buy the debts, previously HFO capital (caymen) and now HFO Capital (Ireland) for tax avoidance purposes, they then assign it to HFO services to collect in England.
BarclayCard wrote this money off already and has received the tax break for it. It's likely also that over the duration of these accounts alot of people probably have paid the account off if you were to do a P&L account on it, so in theory Barclaycard may of lost nothing apart from not gaining more profit, so lets not feel too bad for them.
Where I previously talked about the agreement probably not being enforcable I am merely giving options. Im not telling Lifeonaloop not to pay his debts. I know the pressure, the tactics and the methods of this DCA and my advice is directed in showing that despite what they say, all the cards are not held by HFO, they cannot bully him into doing and paying what they want.
I spoke about the agreement not being enforcable because if you know it isn't, you then know HFO can't obtain judgment against you and when challenged the pressure and harrassment certainly curtails. Be assured that unless you stand up for yourself against these bullys , they won't stop.
